Using a Lawyer
Many financial professionals recommend hiring a lawyer specializing in bankruptcy law. Bankruptcy attorneys are able to stay up to date on all legal changes, and can give advice on the best ways to legally protect assets from forfeiture during the bankruptcy process. Additionally, lawyers can help individuals avoid making costly mistakes due to inexperience.
Filing Pro Se
While lawyers are usually recommended, individuals also have the option of representing themselves in bankruptcy court. Filing bankruptcy “pro se”–without a lawyer–can potentially save legal fees if the individual is familiar with Oregon financial law. Filing pro se is significantly easier if an individual has few assets and a fairly simple case.
Bottom Line
Unless a person has legal experience and is familiar with the law, using a bankruptcy attorney is often the best choice. Pro se or do-it-yourself bankruptcy should be reserved as a last resort. The courtroom is not a place to “learn on the fly,” and mistakes can result in costly fines.
